Meeting:        Salem Licensing Board was held Monday, April 8, 2013 at 6:00 pm in the third floor conference room, 120 Washington Street. Present were Chairman Bob St. Pierre and members John Casey and Rick Lee, Det. Sgt. Page and Clerk of the Board, Melissa Pagliaro.
                
Approved:       Application for a Blanket Entertainment & Vendors License. Applicant: Ellen Talkowksy, City of Salem for the MA Poetry Festival.
        Ms. Talkowksy said that the Coty is working with Ma Poetry for their third annual event.  She said it will run for 3 days with Saturday most likely being the biggest day. She said there will be a stage in Derby Sq and possibly some performers walking through the mall area and local vendors. She also said that there are four big events that week end which are Clean Salem, Salem Education and MBTA recycling.  
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Applications for various Street performers. Applicants that showed were Kevin Sternweis.
Mr. Sternweis said that he did not have a license last year but he has had them for the last five years before that. He said that he plays the guitar and mandolin and sings.
                Mr. Casey said asked if he is aware of the rules and that there is no amplification.
Mr. Sterweis said he read them.
                Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for a renewal of a sub licensee fortunetelling license for A Sacred Place Wellness Center, East India Mall. Applicant: Patricia Gilbride. Present: Darrell Bennett, owner.
        Ms. Bennett said that Ms. Gilbride has a very extensive history and has had a license with A Sacred place for the last two years. .
        Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for a Change of Premise.  Applicant: Rockafellas, Essex Street, for a 12C  Caterer’s License. Present: Dave McKillop, part owner.
        Mr. McKillop said that having this license will allow them to cater events with all alcohol.
        Mr. Casey asked who would serve at these events.
Mr. McKillup said that he has a list of serv safe employees.
Mr. Casey motioned to approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for Change of Manager at the Knights of Columbus. Applicant: John Mizioch
        Mr. Mizioch said that the current bar manager gave his two week notice and the Board voted him in as manager. He said he is TIPS & serv safe certified. He said he has worked with bars for 25 years and has run almost every aspect of the business.
Mr. Casey said that years ago K of C had some issues with noise and neighbors and since the board called them in on that there have been no problems. He said he just wanted to make sure that Mr. Mizioch was aware of that history.
Mr. Casey said that the only item missing is the Vote of the Board and once that is in the application can go to the ABCC.
Mr. Casey motioned to approve.
Mr. Lee seconded.
Mr. St. Pierre said all are in favor. Motion carried.
                
Approved:       Application for a Common Victuallers License. Applicant: Medusa’s Café, 120 Washington Street, formerly Taste of Thyme.  Present: Nick Solomos and Chrysanthy Prousalis
        Mr. Casey asked about what the operating hours will be.
        Mr. Solomos said that it would be 7 days a week from 7am-3pm.
        Ms. Prousalis said that they plan on opening as soon as their serv safe certificates come in and they get the BOH permits.  She said that everything will just about stay the same except they are changing the menu a bit.
Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.
                
                Mr. Casey then said they have an application for an entertainment license for 1 television and piped in music.
                Mr. Casey motioned approve.
                Mr. Lee seconded.
                Mr. St. Pierre said all are in favor. Motion carried.

Approved:       Application for a Seasonal All Alcohol License at the Salem Golf Course, Willson Street. Applicant: Sidekim, LLC d/b/a Tee Time Grille.
        Mr. Mikedis said he also does the Meals on Wheels and serves from Salem to Rockport 5,000 a day.
        Mr. Lee said that there seems to be a problem in that no one ever stays long.
        Mr. Mikedis said he is taking a different approach where he is going to focus on food not just golf. He said he knows this is all rushed but it has been a bit hard working through the RFP.
        Ms. Pagliaro suggested the LB grant a C/V in the meantime so he could begin serving food before the ABCC approved the application.
        Mr. Casey asked if that is what Mr. Mikedis would like to do.
        Mr. Mikedis said he would and it would be 7 days from 7am to 11pm.
        Mr. Casey asked about entertainment.
        Mr. Mikedis said that they have a television.
        Mr. Casey motioned to approve entertainment and Seasonal License pending the rest of paperwork being submitted to Ms. Pagliaro.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carried.

Discussion:     Lobster Shanty, 25 Front Street regarding 2013 Entertainment License. Present: Diane Wolf, Owner.
        Mr. St. Pierre asked for a motion to allow one of the neighbors to speak briefly.
        Mr. Casey motioned to approve.
        Mr. Lee seconded.
        Mr. Dalton said that he lived in an abutting building at 26 New Derby Street for the last 4 years. He said that the Lobster Shanty is a very good business. He said that it is just the entertainment that is hard to bear on the weekends. He said he did call the police a lot last summer. He said he is not looking to have anything cut back or restricted from them just some middle ground. He said he knows he chose to live downtown and this goes along with that.
        Mr. Casey asked if the outdoor ever goes beyond 11pm.
        Mr. Dalton said no and that they are very respectful of the rules.
        Ms. Wolf said that she keeps a log book of almost everything that happens at the Shanty. She said that she has no problem working issues out with neighbors and she has not re booked some bands if they were ever asked to turn it down and did not.
        Mr. St. Pierre said that this is the nature of the business. He said that when the downtown was designed with all of these restaurants it was considered as part the ambience. He said that most of the condos came after.
        Mr. Dalton said he gets and for the most part it is ok but that most Fridays nights are the worse. He said they are working professionals preparing to have a second child and in the summer they usually cannot open their windows.
        Ms. Wolf said that Friday nights are house bands so she will talk with them. She also said that unfortunately that when the Board set the restriction a couple of years ago to have the speakers turned inward toward the business she thinks it might now sound directly toward this abutters place. She also just wanted to note that she gave up having drummers in her bands except of Sunday afternoons and rolled the hours back to 11pm voluntarily to try and help issues with abutter’s.
        Mr. St. Pierre said that the abutter and the business owner seems to have an amicable relationship and thinks they will be able to talk this out.

Approved:       Application for a Change of Corporate name for 62 on Wharf from Dinemed Restaurant Group to 62 on Wharf Restaurant & Wine Bar, Inc., 62 Wharf Street.
        Mr. Casey said it appears that all paperwork is here.
        Mr. Casey motioned to approve.
        Mr. Lee seconded.
        Mr. St. Pierre said all are in favor. Motion carried.           

Commun-
ications:       *Mr. Casey did not receive the state’s OUI list and asked if Ms. Pagliaro could re send it to him.      

OLD/NEW
BUISINESS:      *Mr. St. Pierre said that the City received a decision regarding Mazda back from the Court and it was in the City’s favor.      
*Mr. Casey asked Sgt. Page to go down by the Marblehead line where a person is selling cars. He said this same person was a problem some years ago. Sgt. Page said he would go by and also alert police patrols in that area.   
*Mr. Casey said that Mandee’s pizza has had a window that has been boarded up for months after an accident. He said there is a large amount of trash flying around in that corner and it looks horrible. He says he has received constituent calls regarding it. He asked Sgt. Page to go by.
